Terms and Conditions
  1. Our Company will not be liable for:
    A. Damage caused by fire, flood, or any other abnormal cause which may affect the normal operation of the equipment.
    B. Switches in the "off" position.
    C. Blown fuses or tripped circuit breakers.
    D. Lack of water in a hot water or steam system.
    E. Labor and materials required to restart burner prevented from operating because of an empty oil tank, sediment, water, or foreign materials in oil tank.

  2. Our Company will not be liable for repair or replacement of obsolete or discontinued parts. Our obligation is limited to the availability of parts from local sources of supply. Any parts, including, but not limited to, obsolete parts, will be replaced with modern equipment and billed to customer at normal retail prices for material and labor. "Chargeable Services" rendered to you include travel time, trips to supply houses and the completion of associated paperwork.

  3. Service will be performed as soon as feasible under normal conditions. All services will be scheduled on receipt of due notice, subject to any delays or other inability to perform caused by or due to prior calls, acts of God, or the public enemy, war, terrorism, floods, fire, strikes, transportation difficulties, or other causes beyond our direct control, including unoccupied house. In no event shall we be liable for unoccupied house. In no event shall we be liable for any consequential damages or injury.

  4. Our Company will assume no responsibility for any equipment serviced by any other party other than our company, if the customer's fuel oil needs are serviced by outside parties or should the location cease to be an active fuel oil customer of our company, we will assume no responsibility for equipment failure or resulting damages.

  5. It is the obligation of the homeowner to provide adequate draft in the chimney. We advise the homeowner to have the chimney (s) inspected and cleaned as required by a professional chimney cleaner. Our Company will not assume responsibility for damages resulting from soot, obstructions or other related chimney problems.

  6. When our company deems it necessary, due to hazardous conditions or the customer's health and well-being, immediate repairs may be made. After work has been rendered to the satisfaction of Our company, the customer will be notified of the cost involved and if any further work is required.

  7. All terms and conditions are contingent upon the individual account being maintained in accordance with the standard credit terms. If we do not receive payment in full within 30 days of transaction, a Finance Charge will be added to your account equal to 1% monthly or 18% annually on the past due balance.

  8. If the customer shall breach this agreement or default under the terms hereof, the customer shall pay all charges, including reasonable finance charges, together with any/all costs of collections fees, including a reasonable attorneys fee.

  9. Our Company will supply your entire needs of heating oil. We shall make deliveries in accordance with our automatic delivery system. Printed meter tickets will be left on your premises as evidence of delivery and quantity delivered on said date. It is agreed that any tax or other charge imposed on fuel oil by any governmental authority will be added to the price and paid by the customer. It is understood that our company shall not be liable for damage arising from failure to make deliveries due to fire, labor, or transportation difficulties, or consequential damages arising from impassable driveways or obstructed fills. We appreciate your business and will do all in our power to keep you a satisfied customer.

  10. Bills are payable upon receipt. Budget accounts are payable on the first of the month. Buyer agrees that our company may stop oil deliveries without notice if payment is not received when due.

  11. Inspection of your oil burner is required prior to issuing the "Service Agreement". Our Service Department's first visit to your home will constitute the required inspection.

OUR COMPANY IS AUTHORIZED TO INVESTIGATE MY CREDIT RECORD AND TO VERIFY MY CURRENT EMPLOYMENT AND INCOME REFERENCES AND TO REPORT MY PERFORMANCE OF THIS AGREEMENT TO PROPER PERSONS AND BUREAUS. A CONSUMER REPORT MAY BE REQUESTED DURING THE LIFE OF THE ACCOUNT. YOU MAY ASK TO BE INFORMED OF WHETHER A CONSUMER REPORT WAS REQUESTED AND IF SO, THE NAME AND ADDRESS OF THE CONSUMER REPORTING AGENCY FURNISHING THE REPORT. BY SIGNING BELOW, I UNDERSTAND THAT IN EXTENDING CREDIT, OUR COMPANY IS RELYING ON THE FOREGOING APPLICATION AND FINANCIAL INFORMATION, WHICH I ASSURE YOU, IS TRUE AND COMPLETE TO THE BEST OF MY KNOWLEDGE.
